LEGAL ALERT

Clients and Interested Parties:

The information below represents a non-exhaustive list of FCC regulatory assessment and reporting requirements coming due July 1, 2008 through August 31, 2008. The filing deadlines generally apply to diverse types of service providers, including interexchange or long distance telecommunications service providers, prepaid calling card providers, wireless providers and MVNOs, as well as other types of providers. If your company holds an FCC 214 authorization, chances are that one or more of the requirements covered in this Alert may apply to your company. Interest on late payments and/or other penalties may apply if filings or payments are not submitted on time.

FCC Form 499-Q - Due August 1. All interstate and international providers of telecommunications within the U.S. that do not meet the definition of de minimis provider are generally required to file the Form 499-Q. The proposed contribution factor for USF for the third quarter of 2008 is 0.114 or 11.4% of interstate and, in most cases international, end-user revenues.

Section 43.61 International Telecom Traffic Report - Due July 31. All carriers, including resellers, which provided telecommunications services between the U.S. and foreign points during the previous calendar year are required to file the traffic report.

Prepaid Card Provider PIU Report - Due August 14. All prepaid calling card providers must submit Percentage of Interstate Usage ("PIU") factors (and call volumes on which these factors were calculated, based on not less than a one-day representative sample) to carriers from which they purchase transport services. Contracts with such underlying carriers may specify additional requirements.

If you need assistance in submitting any of these reports or other FCC filing obligations, please do not hesitate to contact us.
