The official FCC
regulatory fee payment window for fiscal year 2008
(based upon a provider’s calendar year 2007 revenues)
opened August 26, 2008 and will close September 25,
2008. Regulatory fee payments, along with FCC Form 159,
are due no later than 11:59 pm on September 25, 2008.
In addition to authorized interstate and international
service providers, other providers generally required to
pay regulatory fees to the FCC include prepaid
providers, wireless providers, MVNOs, resellers of
telecommunications services, and earth station
licensees, among others. With very few exceptions, any
company that reported interstate and/or international
revenue on its FCC Form 499-A is subject to the
regulatory fee obligation based on those reported
revenues. Interconnected VoIP providers will also need
to pay regulatory fees on revenue generated in calendar
year 2007.
Most interstate/international service providers that
timely filed an FCC Form 499-A on April 1, 2008 should
receive a regulatory fee invoice from the FCC. However,
invoices are only provided as a convenience and all
entities subject to regulatory fees are required to
submit payments and an FCC Form 159 regardless of
whether an invoice was received.
Any payment received after 11:59 pm, September 25, 2008,
will be subject to a statutorily required 25% late
payment penalty. In addition, nonpayment can potentially
result in additional forfeitures and penalties, as well
as dismissal of pending FCC applications.
